Flareguide template license agreement

This Software License Agreement ("Agreement") is a legal agreement between you ("Licensee") and Emlin Systems ("Licensor") for the use of the software product Flareguide ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms, do not install or use the Software.

TL;DR: Licensee can use Flareguide in unlimited private and commercial products but may not create a similar product to Flareguide. The license is personal and non-transferable.

1. GRANT OF LICENSE

Licensor grants Licensee a personal, non-exclusive, non-transferable license to use the Software for unlimited purposes, both private and commercial. This license does not grant ownership of the Software, only the right to use it as permitted under this Agreement.

2. RESTICTIONS

Licensee may not:

- Distribute, sublicense, sell, or otherwise transfer the Software to third parties.

- Use Software to create any derivative works or competing products, such as monorepo template or code boilerplate products.

- Use the Software for any unlawful or malicious purposes.

3. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Licensor's total liability under this Agreement is strictly limited to the amount paid for the Software. Under no circumstances shall Licensor be liable for any indirect, incidental, consequential, or special damages arising out of the use or inability to use the Software, including but not limited to loss of data, business interruption, or loss of profits.

Flareguide relies on third-party services, including but not limited to Cloudflare. If Cloudflare or any other third-party service changes its policies, infrastructure, or functionality in a way that affects Flareguide's performance, Licensor shall not be held responsible for any resulting issues or damages, as these changes are beyond Licensor's control.

4. WARRANTY DISCLAIMER

The Software is provided "AS IS" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of the use or performance of the Software remains with the Licensee.

5. TERMINATION

This Agreement is effective until terminated. Licensor may terminate this Agreement if Licensee fails to comply with its terms. Upon termination, Licensee must cease using and destroy all copies of the Software.

6. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts in Sweden.
